Content Removal & Complaints Policy

1. Introduction: This document sets out our Content Removal and Complaints Policy (the “Policy”). If you are a User of the Squirt.org® (“Squirt”, “We”, “Our”, “Us”) mobile device or web software application (collectively, the “Squirt Software”), this policy forms part of your agreement with Us.

2. Who We are and how to contact Us: The Squirt Software is operated by Pink Triangle Press. Our offices are located at: 2 Carlton Street, Suite 1600, Toronto, Ontario, Canada M5B 1J3. The easiest and the fastest way for Us to assist you is to complete a Contact Us Form here. You may also email the customer support team at dickhunter@squirt.org

Our helpful customer support team is available from 8:00 am to 2:00 am ET, seven days a week (excluding December 25th)

3. Interpretation: In this Policy, defined terms and conditions have the same meaning and application as set out in the Squirt Terms and Conditions of Use Agreement. In addition, the term “business days” means any day which is not a Saturday, Sunday or public holiday in Canada.

4. Who can use this Policy: Whether or not you are a User of the Squirt Software, you may follow the provisions of this Policy to alert Us to any complaint you may have regarding the Squirt Software.

5. How to make a complaint: If you have a complaint about the Squirt Software, including any content appearing on the Squirt Software, or the conduct of a User, you have the following simple and convenient ways to contact Us:

a.  For those Users that already have an active profile account on the Squirt Software, the best, and most effective way to file a complaint is to submit a Moderator Report by clicking on the “Report” option available in each section of the Squirt Software platform.

b.  If you are not a User of the Squirt Software, your best option to register your complaint with Us is to submit a Content Removal and Complaints Form here.

c.  You may also email Us at dickhunter@squirt.org.

d.  In all cases, please include your name, User ID (if applicable), address, contact details, a description of your complaint, and if your complaint relates to content appearing on the Squirt Software, the URL for the content to which your complaint relates.

6. How We deal with complaints of illegal or non-consensual content: Following receipt of your complaint of illegal or non-consensual content submitted in accordance with Section 5 above, We will:

a.  Take such steps as We consider to be appropriate to investigate your complaint in good faith, and within a timeframe which is commensurate with the nature and scope of your complaint, but no more than seven (7) business days;

b.  Contact you if We require further information or documentation from you.

c.  Immediately remove such content if We determine that the content is unlawful or non-consensual, and We will notify you of our decision by email or other form of electronic communication.

d.  Notify you by email or other form of electronic communication if we are satisfied that the content is not unlawful or non-consensual.

e.  We reserve the right to resolve any dispute regarding our determination of whether or not content is lawful or non-consensual by submitting the matter to a neutral third-party arbitration service at our expense.

7. How We deal with complaints related to copyright infringement: As set out in the Squirt Terms and Conditions of Use Agreement, you must notify Us as soon as possible if you believe that your intellectual property or other proprietary rights have been infringed upon. Your notification must provide us with enough information to easily locate the content in question. Further, you must actually hold said rights to the material allegedly being infringed and provide documentary evidence to support your claim. We will investigate your notification as required by law and take the appropriate action.

8. How We will deal with other complaints: Following receipt of other types of complaints, including complaints related to other breaches of the Squirt Terms and Conditions of Use Agreement, as submitted in accordance with Section 5 above, We will:

a.  Take such steps as We consider to be appropriate to investigate your complaint in good faith, and within a timeframe which is commensurate with the nature and scope of your complaint.

b.  Contact you if We require further information or documentation from you.

c.  Take reasonable steps in good faith to appropriately resolve the issues(s) raised in your complaint.

d.  Please note, however, that We are not obligated to inform you of the final outcome of your complaint.

9. Notice re unjustified or abusive complaints: Should you elect to file a complaint with Us, you warrant (which means you are making a legally enforceable promise) that you will not make any complaint which is wholly unjustified, abusive, or is made in bad faith. Further, if you are a registered User of the Squirt software, and We determine that you have breached this warrant, We may suspend or terminate your User account.
